Social Security Disability for Veterans with a 100% Rating

Social Security Administration has a new policy to expedite Veterans claims that are rated 100 percent disabled by the Veterans Administration (VA).

There will be an upcoming data match to identify, flag, and message all pending SSA disability claims filed by Veterans who possess a VA compensation rating of 100% P&T as of February 28, 2014.

On March 17, 2014, the Social Security Administration (SSA) implemented a new policy to expedite disability claims of all Veterans rated 100% P&T by the VA, who subsequently filed for SSA disability benefits (see EM-14013).

To receive expedited processing, these Veterans must self-identify and provide verification of their VA rating of 100% P&T.

On May 2, 2014, the Veterans Administration signed an agreement with SSA to provide a one-time data match file to allow SSA to identify and flag for expedited processing all Veterans rated 100% P&T as of February 28, 2014 with a disability claim pending with SSA at all levels of adjudication.

Therefore 100% P&T Veterans' applications are treated as high priority and Social Security will issue expedited decisions.

Many of our clients are members of the Wounded Warrior battalion and as such have VA disability ratings.  These clients should report their VA rating immediately so as to be included in the expedited hearings.  Many of our recent veterans are still on active duty in the Wounded Warriors program, where they continue to receive military pay while they attempt to get medical treatment and determine whether they will be able to continue to serve or transition to civilian life.  This wonderful program allows injured military to begin the tough transition while still receiving pay and medical care.  Often this is a good time to begin the process of applying for Social Security Disability.
